Terms of Use
BabyTracking – baby tracking app
Document version and effective date: October 4, 2026
1. Provider and scope
These terms apply to the BabyTracking iOS/iPadOS app and its cloud services. The provider is Maximilian Fröhlich, c/o Melissi, Schönhauser Allee 99, 10439 Berlin, Germany, email maxfroehlich@gmx.net. The app is intended for adult parents and other legal guardians. Mandatory consumer rights remain unaffected.
2. Service
BabyTracking supports private documentation of breast and bottle feeding, sleep, diapers, custom activities and moment photos, with analyses, Live Activities and optional reminders. Local mode keeps care and moment data on that device; BabyTracking does not provide its own cross-device backup for it. Cloud mode stores and syncs these contents, including photos, through Supabase with authorised household members.
The app is a documentation tool, not medical advice, diagnosis or treatment, and does not replace a doctor, midwife or other qualified professional. Seek professional help for health concerns or emergencies.
From BabyTracking 1.0 (build 33), local care and health records, moment photos, account recovery copies, pending synchronization changes and personal settings are excluded from automatic device backups, including iCloud Backup and corresponding computer backups. BabyTracking does not use HealthKit and does not store or synchronize these contents through CloudKit or iCloud Drive. Optional cloud synchronization uses Supabase; provider backups use our own server in Germany without iCloud.
Local content is not restored from a device backup after device loss, uninstalling the app or restoring the device. In cloud mode, successfully synchronized content can be downloaded again after signing in; content stored only locally or not yet synchronized may be lost. The app cannot retroactively delete older device backups. An export saved by the user or a copy in the system photo library is subject to the chosen service's settings. The provider's statutory obligations and the rights under section 9 remain unaffected.
3. Account, consent and security
Cloud features require email/password or Sign in with Apple and separate explicit consent for cloud processing of sensitive care and health data. Local mode remains available without that consent. If a cloud account already exists, switching through the consent screen schedules its deletion under section 10 after a separate confirmation.
Users must provide accurate details, use secure and unique credentials, protect their device and account, and promptly report suspected misuse. Invitation codes must be treated as access credentials and shared only with trusted people.
4. Households and content
A cloud household can be shared using a time-limited six-digit code. Every authorised member can view and edit the household’s child details, care entries, notes and moment photos. Users may enter or share information about a child or another person only when authorised to do so. Each user remains responsible for the legality and accuracy of their content.
5. Prohibited use
Users may not submit unlawful content; infringe third-party rights; scrape the service; mass-test invitation codes; bypass safeguards; access accounts, databases, storage or interfaces without authorisation; introduce malware; perform denial-of-service attacks; reverse engineer except where mandatory law permits it; or commercially resell the service without consent. We may use proportionate measures such as request limits and temporary blocks to prevent misuse.
6. BabyTracking Pro and purchases
Some features may require a monthly or yearly subscription. The available product, price, duration and trial information is shown before purchase. Apple handles purchase and billing. Auto-renewing subscriptions are managed and cancelled in Apple ID settings. Cancellation, withdrawal and refunds are governed by mandatory law and applicable Apple terms. Existing purchases can be checked through “Restore Purchases”.
Deleting the BabyTracking account does not cancel an Apple subscription; users must cancel it separately through Apple.
7. Intellectual property
The app, design, source code, text and marks are protected. Users receive a personal, non-transferable right to use the app on supported Apple devices while the agreement lasts and subject to Apple’s rules.
Users retain rights in their photos, notes and other content. For cloud functions they grant the provider a purpose-limited right to store, copy, transmit, back up and display that content to authorised household members for the duration necessary to provide the service.
8. Availability, maintenance and backups
We aim to operate the app securely and reliably but do not promise uninterrupted availability. Maintenance, app or OS updates, internet/device problems, Apple, Supabase or RevenueCat outages, cyberattacks and events beyond our reasonable control may temporarily restrict functions.
A daily encrypted backup of the database data and moment photos stored in Supabase is configured on a server operated by the provider in Germany. It runs independently of the provider’s MacBook. Archives are encrypted using a separately held recovery key; archives older than seven days are removed during the daily backup run. A first real backup and an isolated restoration of the database and photos were successfully verified on September 23, 2026. Syncing between app devices does not replace a backup.
An outage, deletion or error may cause data loss; complete or immediate recovery is not guaranteed. A new sign-in may be necessary after a complete outage. This description of the current service does not limit our legal obligations, particularly under Article 32 GDPR, or data subjects’ rights.
Users should keep a suitable additional record of especially important information. This advice and the description of the current service limit neither our legal obligations, particularly under Article 32 GDPR, nor users' defect and liability rights under section 9. They do not transfer our responsibility to users.
For security incidents, we may temporarily restrict functions, terminate sessions, rotate keys, require updates or take other necessary protective steps. We notify authorities and affected people where required by law.
9. Defects and liability
Statutory defect rights apply. Reminders, statistics and timers may be incomplete or delayed due to incorrect input, device state or technical faults and must not be the sole basis for medical or safety-critical decisions.
The provider has unlimited liability for intent and gross negligence, culpable injury to life, body or health, product liability and any other mandatory statutory liability. For ordinary negligence that breaches an essential contractual duty, liability is limited to foreseeable loss typical of the contract.
For cyberattacks, database or provider failures, transmission errors and other events outside our reasonable control, we are liable only to the extent that we are responsible, including where reasonable security, selection, monitoring or response duties were breached. This limitation does not apply to the mandatory cases above, data-protection claims or guaranteed characteristics.
Users are liable under applicable law for culpably unlawful content, deliberate attacks and disclosing invitation codes to unauthorised people. They are not automatically liable for every misuse of their account.
10. Account deletion
Deletion is started in Settings or through “Delete cloud account and continue locally” and scheduled for seven days. Switching locally requires a separate confirmation. Deletion can be cancelled during that period after signing in again; cloud functions are blocked meanwhile. Choosing “Delete cloud account and continue locally” preserves care and moment data already on this device as a local copy. Cloud deletion does not remove this copy; it can be deleted separately in the app. After seven days, the account, profile, consent record, Apple authorisation and linked RevenueCat customer profile are removed.
For a one-member household, cloud entries and moment photos are removed. If other members remain, jointly maintained entries and photos remain for them; the deleted user’s creator attribution is removed and required administration is transferred. Content that should not remain should be deleted beforehand or raised with the provider.
Encrypted database and moment-photo backup archives are stored on a server operated by the provider in Germany and removed during the daily backup run after seven days. Previously backed-up data may therefore remain in encrypted backups after deletion from the active system until the corresponding archive rotation. Backup archives are used for recovery and are not accessible through the app.
11. Term, suspension and termination
The agreement continues indefinitely. Users may end it at any time through account deletion or, in local mode, by stopping use and removing the app.
We may proportionately restrict or terminate an account for a material or repeated breach, a concrete security risk, unlawful use or binding legal reasons. Unless immediate action is needed to protect people, data or systems, we provide notice and an opportunity to remedy. A free cloud service may be discontinued with reasonable notice. Mandatory rights, paid Apple entitlements and possible refund claims remain unaffected.
12. Changes
We may change functions or these terms prospectively for objective reasons such as law, security, technical development or provider changes. Material changes will be announced in advance with their content, reason and effective date.
Where renewed consent or express acceptance is legally required, continued use alone is not treated as acceptance. Without required acceptance, cloud use may end; local mode and statutory rights remain available.
13. Privacy
Personal data processing is described in the Privacy Policy.
14. Consumer dispute resolution
The provider is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board. The former EU Online Dispute Resolution platform was discontinued on July 20, 2025, so no obsolete platform link is provided.
15. Governing law and final terms
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory protections of a consumer’s country of habitual residence remain unaffected. Statutory consumer venues apply; an exclusive venue at the provider’s place of business applies only to businesses where legally permitted.
If a clause is ineffective, statutory rules apply in its place and the remaining clauses continue where legally possible. Contact: maxfroehlich@gmx.net.
